Don’t Suffer in Silence…

Should you find yourself subject to a criminal investigation, which has subsequently resulted in the Prosecution Authorities making an application to the Court for a Restraint Order, please do not suffer in silence.

In short, the purpose of the Restraint Order is to prohibit the Defendant’s assets from being dissipated as the Prosecution have a reasonable cause to believe that the Defendant has benefited from the proceeds of crime.

A Restraint Order can be imposed on a person even before a Defendant has been found guilty of any offence. In fact all that is required is that there is an on-going criminal investigation with regard to that offence and there is a reasonable cause to believe that the alleged offender has benefited from his criminal conduct.

This draconian criterion can become very arduous on a Defendant as they are not allowed to freely deal with their assets in a manor they deem appropriate and it can become very difficult for them to carry out their financial obligations on a day to day basis.

Not only can the imposition of a Restraint Order have very severe implications on the Defendant’s ability to make a living, but it can also affect their ability to pay any mortgages they may be required to pay, and other associated costs they are required to observe.
